One Day Is Today Collaborative Book

By submitting a payment, you are acknowledging you've read and agree to the following terms:

This agreement between Tikkun Group LLC and the author (referred to as Author in this agreement) agreeing to contribute a chapter to the One Day Is Today (tentative title) book, specifies the terms and conditions of the engagement. The book will be published by Branded Expert Press, referred to as Publisher in this agreement.

By signing up to contribute content, referred to as Submission, to the book, the Author agrees to submit the following items to Publisher on or before deadlines specified by Tikkun Group LLC:

• 1500 to 2000 word chapter on a topic related to their niche

• 500 word maximum “about the author”

• Contact Information they want to include in the chapter including email address, phone/text, and up to three social media links

• A profile picture of at least 2" x 3" and a minimum of 300 DPI

• Alternatively, instead of the written submission of the above, Author can submit an MP3 of at most 20 minutes, and Publisher ghostwriters will create the chapter for their review. One Day will provide instructions and deadlines on this option.

• Another option is to have Publisher perform an interview with Author and Publisher ghostwriters will create the chapter for Author review. One Day will provide instructions and deadlines on this option.

In addition, Author acknowledges that they have obtained the necessary rights to grant Tikkun Group LLC and Publisher the rights to publish their Submission, regardless of format with which it is submitted.

Important Detailed Terms & Conditions Author agrees to:

You are representing to Tikkun Group LLC that you have obtained all rights necessary to the information you provide and grant Tikkun Group LLC the publishing rights outlined in this Agreement.

You are solely responsible for obtaining copyright permission for any portions of your Submission that are not fully owned by you. You also agree to notify Tikkun Group LLC of any portions of your Submission where the copyrights to the material are owned by a third party.

You represent and warrant that no material in your Submission would be considered false, inaccurate, libelous, obscene, or injurious to another party in any manner, and it does not contain any material that would violate any right to privacy, personal or proprietary act or other common law or statutory right and that the use of any instruction, formula, recipe or other material from your Submission will not result in injury or harm to another.

You acknowledge that your Submission is not plagiarized and does not include falsely attributed statements of third parties. You represent that you are the owner of any trademarks and/or trade names associated with your Submission and that the usage of such trademarks or trade names does not infringe upon the rights of third parties.

You agree to indemnify and hold Tikkun Group LLC and their affiliates and assigns harmless from all suits, claims and proceedings which may be taken against you or Tikkun Group LLC as a result of anything you say, your failure to disclose or you misrepresent your proper ownership of or rights to your Submission.

You are granting Tikkun Group LLC and affiliates the right to use your Submission in the promotion of the book.

Tikkun Group LLC makes no warranty or guarantee concerning any minimum sales of the book.

You are assigning to Tikkun Group LLC and our partners the rights to print, publish, distribute and sell the content you have submitted as a part of the book throughout the world in all languages. You also agree to allow Tikkun Group LLC to make excerpts from the book viewable on our website and/or partner websites for promotional purposes.

You are granting Tikkun Group LLC and our assignees the non-exclusive, worldwide rights to use and repurpose content from your Submission, for our publications and media for the purpose of helping Tikkun Group LLC promote and sell the book.

You understand that Tikkun Group LLC is going to secure US copyright for the book, including the content you have submitted in the name of One Day. However, you shall have the right to republish your work in any manner you desire and you and Tikkun Group LLC agree this shall not be deemed an infringement on the copyright.

All parties agree to execute all documents necessary to protect, assign and renew the copyright status of your Submission and the book as a whole.

You understand that this book is being published for the purpose of promoting the businesses and methods of the contributing parties and that no royalties shall be paid to you, interview subjects or any third parties on the sales of any copies of the book.

You agree to indemnify and hold Tikkun Group LLC harmless along with our affiliates and any seller of your Submission from and against any losses, lost profits, damages, liabilities, judgments, awards, decrees, settlements, or expenses (including without limitation, reasonable attorney’s fees and court costs) arising from, connected with, or by reason of any breach or alleged breach of any of the representations and warranties set forth in this agreement.

The parties to this Agreement shall not make any material disparaging or negative comments concerning each other, except to a party’s business advisors and attorneys, or as required by court subpoena or order.

All representations, warranties and indemnities made by you herein shall survive termination of this Agreement. “Affiliates” means owners, shareholders, officers, directors, employees, parents, subsidiaries, affiliated companies, licensees, distributors, advertisers, and any other person or entity to whom we extend or assign our representations and warranties to in connection with the production, dissemination, transmission, promotion, publication or distribution of your Submission or the book as a whole, or the exercise of any rights therein or derived there from. In defending any such claim, action or proceeding, we shall have the right to defend with attorneys of our own selection and to settle the same and you shall fully cooperate in the defense thereof.

The laws of the state of Tennessee shall govern this agreement. By accepting this Agreement, you expressly consent to personal jurisdiction in a court of competent jurisdiction lying in Davidson County, Tennessee, regardless of the place of domicile or principal place of business of any party. Any controversy or claim arising out of this agreement or the breach thereof shall be first mediated and if unsuccessful, settled by arbitration in accordance with the rules of the American Arbitration Association or any similar governing body to which we shall mutually agree to in writing. Venue for any action regarding this agreement shall be Davidson County, Tennessee unless otherwise agreed by Tikkun Group LLC. The prevailing party shall be entitled to an award of attorney fees and costs.

Cost:

In return for Authors Submission being included in the book, the Author agrees to make payment online in the amounts specified below, depending on which package they choose.

Refund Policy: Due to the nature of the product and services there will be no refunds after purchase.

This is meant to be the full agreement between the Author and Tikkun Group LLC.

Any additions or subtractions to the proposal must be made in writing and agreed upon by both parties.

Tikkun Group LLC will immediately commence the project upon receipt of the payment outlined above by Author.
